Navigating EU Maritime Emissions: Identifying your Administering Authority
The EU Maritime emissions rules came into force on the 1st of January, and you have a short period to register with an Administering Authority.
The EU Commission will publish a list before the 1st of February attributing shipping companies to Administering Authorities, giving you 40 days to register. If you are not on the list, 65 days to register with the relevant Administering Authority.
Do you know which administering authority you will be attributed to?
The EU Commission adopted the Commission Implementing Regulation back in November last year which gives guidance on how shipping companies are attributed to an Administering Authority. Now that this Commission Implementing Regulation is about to be published, here is a short summary of the rules:
1- EU registered companies: the Administering Authority of your Member State
2- Non-EU Companies with EU Voyages: The attribution on the list will be to the Administering Authority of the Member State where the shipping company has had the most port calls. That information will be gathered from the SafeSeaNet system established by Directive 2002/59/EC.
If the SafeSeaNet data is insufficient for attribution, then the EU Commission will use complementary information such as the Automatic Identification System data.
3- Non-EU Companies without EU Voyages: the Administering Authority will be that of the Member State where the first port of call on the first voyage of that shipping company took place.
